CMS Introduces Cyberattack Hardship Exemption for MIPS Participants

The Change Healthcare cyberattack has left physicians and practices wary of their patient’s confidential records. Because of this, the Center for Medicare & Medicaid Services (CMS) have added an option for practices to report a cyberattack when applying for a hardship exemption under 2024 Merit-Based Incentive Payment System (MIPS). 

Reporting Challenges in EUC Application

This option is available now when applying for an Extreme and Uncontrollable Circumstance (EUC) application. While filling out this application, an option to report random/malware challenges. Note that documentation is required, but should be retained in the case of potential data validation or audit. In order to avoid a negative payment adjustment for MIPS 2026, these circumstances should be filed and reported by December 31st of this year. 

Physicians can request to adjust the weighting of up to four MIPS categories when applying for a hardship. Adjusting all performance categories can help avoid a penalty of up to 9% in 2026. It is important to note that if a physician or group submits performance data, the hardship exemption will be overridden, and they may be scored accordingly.
